In order to comply with article 10 of Law 34/2002 of Services of the Information Society and Electronic Commerce, we inform the user of our data:


1. Subject matter

The service provider of the website www.ev-finance.es is EV FINANCE SPAIN, S.L.U, with registered office at Calle Génova, no. 27, 5ª planta, Madrid, CP 28004, with tax identification code B44717056.

The company is registered in the Madrid trade register, volume 44867, page 21, sheet M-789890, entry number 1.

The company has corresponding civil liability insurance with the insurance company AXA SEGUROS GENERALES, S.A., policy number 85064888.

As a real estate credit intermediary, it is also duly registered in the Banco de España Register of Real Estate Credit Intermediaries, with code number D842 with code number D842.

This legal notice regulates the use of this domain.

The use of this website implies the user’s acceptance of the conditions of use included in this notice as well as our policies on data protection and privacy and our cookies policy. If certain services, contents and/or tools offered through this portal require the application of specific conditions, these will be communicated to the user.

On the other hand, EV FINANCE SPAIN, S.L.U. hereby advises that both the contents and services of this website and the conditions of use may be modified without prior notification.


2. Services offered by EV FINANCE SPAIN, S.L.U.

Via the EV FINANCE SPAIN, S.L.U. website, the user will be able to access the following services (hereinafter referred to as “services”):

EV FINANCE SPAIN, S.L.U. is an independent real estate credit intermediary that provides interested users with a mortgage brokerage service.

The brokerage service consists of assisting users to find about the general offer of banking entities and facilitate the preliminary procedures or other pre-contractual administration with regard to the loan agreements offered by the partner entities of EV FINANCE SPAIN, S.L.U. (Hereinafter referred to as “partner entities”), in accordance with the terms of Article 4.5 of Law 5/2019 (hereinafter referred to as LCCI).

Mortgage brokering consists of directly or indirectly putting a natural person in contact with a lender (person or company granting the financing) and also performing one of the following functions with respect to loan contracts:

a. Presenting or offering to present such loan agreements to borrowers b. Assisting borrowers with preliminary or other pre-contractual arrangements regarding such loan agreements

In providing these services, EV FINANCE SPAIN, S.L.U. will take into consideration all of the products offered by partner entities as well as the products of other non-partner entities that may be of interest to the user.

Users should bear in mind that during the processing of the loan or credit, it may be necessary to contract other services and products, such as registry checks, insurance or appraisals, notary fees or intermediation fees.

Likewise, all EV FINANCE SPAIN, S.L.U.staff and their designated representatives will act in an honest, impartial, transparent and professional manner, and will respect the rights and interests of users in the provision of intermediation services in accordance with the user's requirements and circumstances and will recommend suitable loan agreement.

EV FINANCE SPAIN, S.L.U. may also facilitate the digital comparison of mortgage products offered by the entities, depending on market conditions and the user’s needs and credit profile (hereinafter referred to as “intermediation services”).

EV FINANCE SPAIN, S.L.U.’s main objective is to help and guide the user in the search for mortgage loans according to the conditions applied by credit institutions in Spain in financing contracts with mortgage guarantee. It also aims to inform users of the characteristics of the mortgages offered by third parties so that they can make the most accurate decision possible when contracting them.

Once the user has been identified and registered online, EV FINANCE SPAIN, S.L.U. can present mortgage products offered on the market by the entities that best match the characteristics of the credit or loan requested by the user, in accordance with the information provided by them to EV FINANCE SPAIN, S.L.U. through the questionnaire to be completed by the user beforehand.

Likewise, in the event that the user does not meet the risk criteria commonly established by the entities, EV FINANCE SPAIN, S.L.U. reserves the right not to present any banking product, and will inform the user of the reason for this.

EV FINANCE SPAIN, S.L.U. will endeavour to offer qualified and personalised information after analysing the financing options that best suit the user's profile, in accordance with the characteristics and needs previously indicated or communicated by the user during the registration process and which may be extended and managed by telephone and through any form of telematic communication.

In compliance with all provisions and taking into account its corporate purpose, EV FINANCE SPAIN, S.L.U. may act as an intermediary for real estate loans, whether in person, by telephone or by any form of telematic communication, in cases where the service requires it. In such cases, EV FINANCE SPAIN, S.L.U. will act as an intermediary between the real estate lender and the user.

Along with its employees, collaborates and agents, EV FINANCE SPAIN, S.L.U. is responsible for determining and analysing loans that best fit the preferences, characteristics and interests of each user and their profile. EV FINANCE SPAIN, S.L.U. may provide the user with general guidance or information on terms, conditions, concepts or clauses relating to offers, pre-contractual or contractual information on loans, without providing specific mortgage advice under the terms of Article 4.20 of the LCCI.

It should be noted that EV FINANCE SPAIN, S.L.U. is not involved at any time in the contracting of the mortgage loan or credit selected by the user. Rather, the final contracting of such a loan or credit is carried out between the real estate lender and the user.

EV FINANCE SPAIN, S.L.U. can also present a comparison of the conditions under which loans may be taken out by different credit institutions according to the preferences defined so that the user can make a more accurate decision when looking for financing.

In any case, EV FINANCE SPAIN, S.L.U. recommends to all its users that before contracting any product or service, they carefully read and review its full terms and conditions and, if necessary, seek legal advice for its correct formalisation.


3. General conditions of use

The user undertakes to provide true, accurate and complete information about their identity in the sections for which registration is required for access Furthermore, they undertake to keep the personal data that may be provided to the domain owner up to date, and is therefore solely responsible for any false or inaccurate information they may provide.

Please note that if you are a minor, you must obtain permission from your parents, guardians or legal representatives in order to access the services provided. EV FINANCE SPAIN, S.L.U. accepts no liability for inaccurate or false information.

The website may only be used for lawful purposes. Accordingly, the user undertakes to make lawful and honest use of the portal and in accordance with these general conditions of use, and agrees not to use the services of the website to carry out activities contrary to Spanish law, morality and public order, and assumes all liability for damages to the domain owner or third parties that may arise from illegal or impermissible practices, including but not limited to:

To carry out any manipulation or alteration of this site without the prior consent of the domain owner, in which case the domain owner will not assume any liability that may arise from such manipulation or alteration by third parties. Carry out any act that may damage, render useless, overload or deteriorate the portal and the services and/or prevent normal use by users. EV FINANCE SPAIN, S.L.U is not responsible for links to other internet sites belonging to third parties and their existence does not imply that EV FINANCE SPAIN, S.L.U approves or accepts their contents and services. Such other websites are not controlled by EV FINANCE SPAIN, S.L.U. and are not covered by the company’s privacy policy.

6. Withdrawal

The user has the right of withdrawal within fourteen (14) calendar days of the conclusion of the relevant intermediation contract, as provided for in Article 20.1 of Law 2/2009 of 31 March, without the need to state any reason or incurring any penalty. In other words, if for any reason the EV FINANCE SPAIN, S.L.U. service is not of interest to the user within this period, the user may cancel it free of charge after signing the corresponding contract.

Nevertheless, in accordance with Article 103 of the revised text of the General Law on Consumers and Users, the user should be aware that if, at the time of the exercise of withdrawal, the contract has already been executed by EV FINANCE SPAIN, S.L.U., the agreed fees may be incurred in the same way.


7. Out-of-court complaint procedure

EV FINANCE SPAIN, S.L.U. informs the user that it has the appropriate internal means for the resolution of any out-of-court claims that may arise, and has duly filed the appropriate procedure for the resolution of any complaints for the services provided with Banco de España.

Such complaints may be addressed, via a durable medium, to EV FINANCE atreclamaciones@ev-finance.es or by post to the registered address at calle Génova 27, 5º planta, 28004, Madrid, Spain. In the event that EV FINANCE has premises open to the public, complaints may also be submitted in person at any of them.

These claims will be processed by the customer service department of EV FINANCE SPAIN, S.L.U. within a maximum period of one month, in a substantiated form and on a durable medium, provided that the complaint has been submitted correctly.

Otherwise, the aforementioned period may be suspended for a period of ten calendar days and EV FINANCE SPAIN, S.L.U. may request as much information and documentation as necessary before processing the complaint.

The procedure carried out by the customer service department will be initiated by the presentation of a document that specifies the following: Name, surname, telephone number, email and postal addresses of the person concerned and, if applicable, of their duly accredited representative; national identity card number for natural persons and data from the public register in the case of legal entities.

Reason for the complaint or claim, with clear specification of the issues on which a ruling is sought.

Confirmation that the complainant is not aware of any administrative, arbitration or judicial proceedings regarding the subject matter of the complaint or claim.

Place, date and signature. Together with the aforementioned document, the complainant must provide a copy of the national identity document or specific power of attorney, as well as the supporting documents in their possession on which the complaint or claim is based. In the event of a disagreement in the resolution of the dispute, the user is free to choose the dispute resolution system. Notwithstanding the above, users are reminded that they are entitled to contact Banco de España in the event that EV FINANCE SPAIN, S.L.U. does not respond to the complaint submitted within a maximum period of one (1) month or if, after receiving the response, they are not satisfied with it. Likewise, and only in the case of claimants who have the status of consumer, the time limit for contacting the Banco de España is limited to one (1) year from the date on which the claim was submitted to the ICI through one of the authorised channels. 8. Applicable law and jurisdiction

These general conditions of use are governed at all times by the provisions of Spanish law. In particular, by Law 34/2002 of 11 July 2002 on information society services and electronic commerce and Law 7/1998 of 13 April 1998 on general contract terms.

The legislation applicable to real estate brokerage agreements is Law 5/2019, supplemented by Law 2/2009. In addition, the following applies: the revised text of the General Law on Consumers and Users, of 16 November, which approves the revised text of the General Law on the Protection of Consumers and Users and other complementary laws; the Royal Decree of 24 July 1889, which publishes the Civil Code, the Law of 23 July 1908, on usury; and any provisions that may be approved by the autonomous communities of Spain in the exercise of the powers assigned to them.

In order to avoid any doubt or disagreement that may arise in the interpretation or validity of the intermediation contract and which could not be resolved out of court between the parties, the parties may choose the jurisdiction of the courts or refer the matter to a consumer arbitration tribunal.
